I. INTRODUCTION
The website www.qinetiko.com(hereinafter the “Website”) is the official online platform hosting the e-shop under the trade name “Qinetiko”. Through the Website, activewear, athleisure, and wellness apparel bearing the Qinetiko trademark, as well as related information and communication services, are presented, promoted, and made available for sale.

The Website is owned by the company “PP GROUP LP”, under the trade name “Qinetiko.com”, with registered office at N. Papadopoulou 8, Ioannina, 454 44, Greece, VAT number EL 801979219, Ioannina Tax Authority, contact telephone +30 2651 313330, and email address info@qinetiko.com (hereinafter the “E-shop”, the “Company”, “we”, “us”, “our”). The Company lawfully manages and operates the Website and the E-shop.

These Terms and Conditions of Use of the E-shop (hereinafter the “Terms of Use” or the “Terms”), which integrally include the Privacy Policy, the Cookies Policy, and the Purchase Terms, set out the legal framework under which you, in any capacity (visitor, registered member, service user, consumer/purchaser), use the Website, receive information (e.g., newsletters), and/or make purchases through the E-shop.

Before accessing the Website and using its Services or placing any product order, you are requested to carefully read these Terms. By navigating the Website, registering, or purchasing products, you are deemed to have read, understood, and unconditionally accepted these Terms and Conditions.

You are advised to regularly visit the Website to stay informed of any changes, as Qinetiko reserves the right to unilaterally amend, update, add, or remove:
a) these Terms of Use, in whole or in part,
b) its Policies,
c) the Services provided,
d) the technical specifications of the Website, in accordance with applicable law and business practices.

Any such changes shall take effect from the date of their posting on the Website. Orders or transactions completed before the effective date of such changes shall not be affected.

Use of the Website and the E-shop is at your sole responsibility. Qinetiko reserves the right, at any time and without prior notice, to suspend or terminate the operation of the e-shop, specific services, and/or the availability of products.

By accepting these Terms, you expressly and unconditionally declare that you are of legal age (over 18 years old) and possess full legal capacity. The Company reserves the right to refuse the sale or delivery of products in cases where there are indications of a breach of these Terms of Use.

II. TERMS OF PURCHASE THROUGH THE E-SHOP (B2C)
Orders placed remotely are executed exclusively through the E-shop www.qinetiko.com . Qinetiko does not accept or process orders submitted via e-mail or through personal messages on social media. Any reference to a product on a return form shall not be deemed a new order. Accordingly, the following terms govern the framework under which retail sales (B2C) are conducted through the E-shop or by telephone orders. The seller is the company PP GROUP LP – Qinetiko.

1. Products
Through the E-shop, Qinetiko displays, promotes, and offers to consumers (B2C) activewear, athleisure, and wellness apparel (hereinafter the “Products”).
Product descriptions and photographs are complete, accurate, and based on actual representations. However, potential technical or typographical errors arising from system failures, operational interruptions, or force majeure cannot be excluded.
Availability updates are carried out immediately by all technical means; however, a short time frame (up to one hour) may be required for the system to be updated.
Qinetiko reserves the right to determine, withdraw, or update its products and pricing policies at its sole discretion, without prior notice.

2. Orders
2.1 Basic requirement for submitting an order
Before completing your order, you must check whether the shipping country and your postal code are served. If not, please contact Qinetiko Customer Service at info@qinetiko.com for information.

2.2 Order submission – Conclusion of the sales contract
Through our E-shop you can select products, add them to your cart, and finalize your order by clicking “Checkout”. You will then be asked to provide personal details and a payment method. Submission of an order constitutes a purchase offer to Qinetiko. The sales contract is concluded only once you receive an order confirmation email.

2.3 Account registration
Creating an account is not mandatory but provides benefits, such as access to your purchase history and address management. Registration is personal and free of charge. Qinetiko does not accept telephone orders.

3. Order cancellation
3.1 By the customer
You may cancel your order in the following cases:

Before final submission, by removing products from the shopping cart.

Within three (3) hours of receiving the order confirmation, by sending an email to info@qinetiko.com

If Qinetiko modifies your order due to lack of availability or inability to execute it.

3.2 By Qinetiko
The Company may cancel your order and/or the sales contract at any stage, in the following cases:
-3.2.1. Due to a technical error, where the product you ordered is unavailable and the system has not yet been updated, or where the product can no longer be supplied for any reason.
-3.2.2. Due to a technical error, where the listed price or description of the product is incorrect.
-3.2.3. Where, at our sole discretion, we determine that there is involvement in unfair practices regarding the order, or where abusive use of the ordering system is identified.
-3.2.4. In the event of non-payment.
-3.2.5. In the event of non-receipt of the products by the customer, in accordance with these Terms.
-3.2.6. Where the execution of the order would contravene laws, rules, or regulations.
-3.2.7. In cases of force majeure (e.g., extreme weather events, pandemics, strikes, or other events beyond the Company’s control).
In all cases of cancellation by Qinetiko, where payment has already been made, the Company shall return the relevant amount to the customer without undue delay.

3.3 After receipt
After receipt of the products, cancellation of the order is possible only by exercising the right of withdrawal, as provided in Article II.8 of these Terms.

4. Prices
All prices are quoted in euros, include VAT, and are deemed final. In the event of a technical error in pricing, Qinetiko will contact you to confirm or cancel the order.

5. Product delivery

5.1 Delivery address
Product delivery is made to the address you provided when placing your order.

5.2 Method and delivery time
Qinetiko cooperates with reliable courier companies for order shipments. Indicative delivery times are as follows:

• Within Greece: 1 to 5 business days, depending on the region.
• Outside Greece: 1 to 15 business days, depending on the country and local transport service.
  These delivery times are indicative and may vary during peak periods, holidays, or due to exceptional circumstances.

5.3 Delay
Delivery may be delayed in cases of force majeure (e.g., extreme weather events, strikes, pandemics), stock shortages, or supplier delays. In such cases, Qinetiko will contact you to inform you and agree on the next steps (delivery with delay, product replacement, order cancellation).

5.4 Liability
Qinetiko remains responsible for the products until you acquire physical possession of them. If you fail to receive the parcel after repeated courier attempts or expressly refuse delivery, the order is returned to the Company and recorded as a refusal. In such case, the return cost, as well as any other costs incurred due to non-receipt or refusal of receipt (including but not limited to: shipping costs, packaging, handling expenses), shall be borne exclusively by the customer and offset against any refund due.
Furthermore, if the address you provided is incorrect, incomplete, or nonexistent, the order is returned to the Company and recorded as Invalid Due to Incorrect Address. Any costs incurred in such case (shipping, packaging, handling) shall be borne exclusively by the customer and settled against the remaining refundable amount, if any.

6. Shipping costs
For orders over €180, shipping within Greece is free of charge. For orders under €180, shipping costs are €3.90. Express deliveries are charged additionally, according to the courier’s price list.

7. Payment methods
Available payment methods:

• Credit/Debit card (Visa, Mastercard),
• PayPal.
  All payments are processed through secure payment systems.

8. Right of withdrawal
In accordance with applicable law, you have the right to withdraw within 14 days of receipt, without providing any justification. You must return the products in perfect condition, with their tags and accompanying documents. Return costs are borne by the customer, unless the product is incorrect or defective (Article II.9). Qinetiko will refund the amount paid within 14 days of receiving the returned products.

9. Incorrect order execution – Defective product
In case of an incorrect product or defect, Qinetiko covers the cost of return and reshipping of the correct product (within Greece). Replacement is subject to availability. If not possible, the full amount will be refunded.

III. TERMS OF USE OF THE WEBSITE

1. Provision of general information
The information provided by Qinetiko through the Website www.qinetiko.com is complete, accurate, valid, and up to date, whether it concerns the Company’s identity and details, or the products (activewear, athleisure, wellness wear) and services offered (e.g., product descriptions, information about the Pilates Studio). However, inadvertent technical or typographical errors arising due to website downtime or incidents of force majeure cannot be excluded.

2. Newsletter subscription
Subscription to Qinetiko’s newsletter service is optional and is not a prerequisite for making a purchase. Users who complete an order or create an account may receive newsletters and updates at the email address they have provided, unless they expressly request their removal (opt-out/unsubscribe).
Subscription may also be made by non-members, by filling in their email address in the relevant field on the Website. By subscribing, you consent to Qinetiko sending you informational and promotional material related to products, services, and brand activities.
If you no longer wish to receive updates, you may request deletion either via the relevant link included in every email, or through the “Contact” section.

3. Advertisements
Qinetiko reserves the right to display advertisements on third-party websites and to cooperate with advertising agencies. When advertisements are displayed, cookies may be used; however, no data that personally identifies the user will be used. For more information, please refer to the Cookie Policy.
Additionally, the Website may host third-party advertisements. Advertisements are checked to ensure compliance with applicable law, respect for third-party rights, and the absence of offensive, misleading, or unlawful content. However, Qinetiko cannot guarantee the full appropriateness of all advertisements and reserves the right to reject or remove any advertisement at any time.

4. External links
The Website may contain links to other third-party websites. Qinetiko bears no responsibility for the content, privacy policy, quality, or services provided by such websites. The existence of links does not imply that Qinetiko endorses or accepts the content of these websites. You are advised to carefully read the terms of use and privacy policies of any external websites you visit.

5. Communication
By using the Website and its Services, you accept that you may receive communications from Qinetiko (e.g., order confirmations, updates, newsletters). Such communications are deemed to meet the legal requirements of written notification. For questions, comments, or complaints, you may contact us through the “Contact” section on the Website.

6. Social Media
Qinetiko maintains official accounts on social media platforms (Instagram, Facebook, LinkedIn, YouTube, etc.). Users may follow our profiles to receive updates on new products, services, events, or promotional activities.
Any interaction with Social Media is subject both to these Terms and to the terms of each platform. Qinetiko does not have access to your personal accounts, nor is it responsible for the practices of such service providers. We recommend that you carefully read the terms of use of each social network before engaging with it.

7.Event Photography and Media Use
By subscribing to the Qinetiko newsletter or participating in any Qinetiko-hosted or affiliated event, you acknowledge and consent that Qinetiko may capture photographs and/or video recordings that may include your image or likeness. You grant Qinetiko a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display such images or recordings—whether individually or as part of a collective work—across any media channels, including but not limited to social media, websites, newsletters, advertisements, and promotional materials, for marketing or informational purposes. You waive any right to inspect or approve the finished material, and you release Qinetiko, its representatives, and affiliates from any and all claims, demands, or liabilities arising out of or in connection with the use of such images or recordings.

IV. RESPONSIBILITIES – OBLIGATIONS OF THE PARTIES

1. User/Consumer Responsibility
You are solely responsible for the lawful use of the Website and the Online Store, in accordance with these Terms. You must refrain from any unlawful or abusive behavior, as well as from practices of unfair competition.

You bear exclusive responsibility for the legality, accuracy, and correctness of all information/data you provide to us. Qinetiko is under no obligation to verify such information unless required by law or due to a complaint.

2. Prohibited Uses
You are prohibited from using the Website/Online Store to post, send, or transmit content that is illegal, threatening, offensive, defamatory, obscene, immoral, and/or discriminatory in nature, or content that could cause harm to third parties.
Specifically prohibited are:

• Infringement of Qinetiko’s or third parties’ intellectual/industrial property rights or trade secrets.
• Introduction of viruses, malicious code, or elements that disrupt or damage software/services.
• Accessing or attempting to access data without authorization.
• Using the e-shop for developing/producing a competing product/service.
• Facilitating unauthorized access to member data by third parties.

Any form of hacking, interception, copying, mechanical reproduction, distribution, downloading, modification, resale, or creation of derivative works of website content/data.Disruption of the website’s operation (e.g., spamming, overloading, attempts to bypass security measures).

Your connection to the Website is carried out through your own means and providers.

3. Limitation of Warranties – Company Liability
Qinetiko acts in good faith, takes technical and organizational measures, and makes every reasonable effort to ensure: (a) uninterrupted operation of the website and e-shop, (b) data integrity and backup, (c) that servers/infrastructure are free from viruses or harmful elements, (d) that products are in perfect condition. Nevertheless, no guarantees are provided, and no obligation to compensate arises for damages resulting from the above.

Qinetiko does not guarantee the suitability/adequacy of products for any particular purpose you may seek, nor is it responsible for fulfilling obligations of third-party users/providers.

We reserve the right to modify/interrupt all or part of the website temporarily or permanently, with or without prior notice. Availability may be affected by your equipment, communication networks, or peak usage conditions. Qinetiko shall not be held liable for inaccessibility, delays, non-delivery, interruptions, or loss of content, nor for technical compatibility issues of your infrastructure.

Subject to mandatory law, Qinetiko disclaims liability for indirect, consequential, or incidental damages (including loss of profit, reputation, or clientele) arising from or related to use/inability to use the website, interruptions, network/ISP/Internet errors, acts or omissions of third parties, or third-party information published on the website.
Qinetiko reserves the right:

(a) regarding delivery times in cases of force majeure, 

(b) to suspend services for maintenance/upgrades, 

(c) concerning product availability, while ensuring timely notification of non-availability.

Qinetiko is liable only in cases of intent or gross negligence and only for direct damages that are causally connected.

If our contractual/legal obligations are not fulfilled due to inaccurate or outdated information you provided, we bear no responsibility; any communication shall be deemed valid even if not delivered.

4. Indemnification
You agree to indemnify and hold harmless Qinetiko, its officers, employees, partners, and suppliers from any loss, damage, or expense arising from: (a) violation of these Terms, (b) non-compliance with applicable law, (c) infringement of third parties’ personal data rights, (d) infringement of Qinetiko’s intellectual property rights. In cases of proven gross negligence by the Company, only direct and demonstrable actual damages directly connected to the harmful event shall be covered.

5. Intellectual Property Rights
All content on the Website (images, graphics, photographs, designs, texts, descriptions, logos, trademarks, promotional material/campaigns, settings/code) is the intellectual and/or industrial property of Qinetiko and/or third-party right holders and is protected by Greek, EU, and international law.

Any copying, reproduction, analog/digital recording, distribution, transfer, downloading, modification, resale, or creation of derivative works, in whole or in part, for purposes other than strictly personal use, without Qinetiko’s express written consent, is prohibited.

Only a limited, non-exclusive, non-transferable license of access and personal use of the website is granted. Resale/commercial use, data collection/extraction (data mining), use of “meta-tags,” linking, or framing without written consent is prohibited. In cases of unauthorized use, the license terminates automatically.

6. Personal Data Protection
The management of your personal data is governed by Qinetiko’s Privacy Policy and applicable legislation (GDPR 2016/679, Law 4624/2019, Law 3471/2006, and decisions/guidelines of the Hellenic Data Protection Authority).
In the Privacy Policy, you will find detailed information regarding: categories of data we retain, purposes/legal bases of processing, recipients, retention periods, data subject rights (access, rectification, deletion, restriction, portability, objection), and security measures.

7. Security
7.1 Customer identification
Qinetiko applies modern technical and organizational security measures to protect transactions and personal data. Access to your account is possible only with a username and secret password. You are responsible for keeping them confidential and for any action performed with them.
7.2 Transaction confidentiality
The confidentiality of transactions is fundamental. All information transmitted by you to Qinetiko is kept confidential and used solely to the extent necessary to provide the services. Indicative measures include:

Only authorized employees have access to transaction data when necessary (e.g., order processing/requests).

Customer/transaction details are not disclosed unless expressly authorized, by court order, or by a public authority mandate.

When third-party providers are used (e.g., hosting/system support, payment providers), confidentiality and security of processing are contractually ensured.

For your own security, treat all information you receive through the e-shop as confidential and do not disclose it to third parties. Regular password changes, use of strong credentials, and logging out after each session are recommended.

V. FINAL PROVISIONS

1. Final Terms
These Terms constitute the final and exclusive terms in force regarding the provision of services and the sale of products by Qinetiko to the User/Consumer, and they supersede any prior terms, agreements, or arrangements (written or oral) between the parties concerning the use of the Website and the Online Store.

2. Waiver
Any delay, inaction, or tolerance by Qinetiko in exercising or enforcing any of its rights shall not constitute a waiver, nor shall it limit its statutory rights and/or rights under these Terms. If any provision is deemed invalid or unenforceable by a competent court or authority, this shall not affect the validity of the remaining provisions, which shall remain fully in force.

3. Invalidity of Terms (Partial Invalidity)
If any part of these Terms is declared invalid, such invalidity shall not affect the remainder of the text. Qinetiko will seek to replace any invalid provision with a new, valid provision that produces, to the extent possible, an equivalent effect to that of the invalidated provision.

4. Applicable Law
These Terms are governed by Greek law. Any dispute relating to the interpretation, validity, performance, or nullity of the Terms shall fall under the exclusive jurisdiction of the competent courts of Ioannina, Greece.
